On Point Insurance Consulting, LLC, d/b/a On Point Insurance Consulting, (“we”, “our”, and “us”) takes the privacy and security of those who visit our website (“you”, “your”, “yours”) very seriously, and we encourage you to read this privacy policy (“Policy”) carefully to understand how we collect, store, and maintain information that you share with us.  This Policy describes the kinds of information we collect from you and the measures we take to protect that information.  All references in this Policy to “website” include all of On Point’s websites. “Personal Information” as used in this Policy means information that can be used to identify you, directly or indirectly, alone or together with other information.

What Information Does On Point Insurance Consulting Collect from Me?

We collect certain information from you when you share that information with us, when you use our website, attend our events, communicate with us such as by e-mail, phone call or text message, interact with us through social media, and when you purchase our products from us.  

  • Personal Information

o We may collect certain personal information you share with us, including, but not limited to, your name, company name, physical address, hometown, telephone number, birthday, gender, and email address. 

o If you create an account with us, we also collect your login and account information, including your username and password.

  • Aggregate Information. Aggregate Information is information that does not identify you in any way.  Aggregate Information may be collected when you visit our website, independent of any information you voluntarily enter.  Additionally, we may use one or more processes to de-identify information that contains Personal Information, such that only Aggregate Information remains.  We may collect, use, store, and transfer Aggregate Information without restriction.
  • Website Information. We also collect certain types of non-personal information whenever you visit our website.  By “Site Visit Information” we mean information that does not directly identify you personally, such as IP address, device information, unique identifiers, and browser information.

Does On Point Insurance Consulting Use Cookies or Beacons?

On Point Insurance does not actively use “cookies” or “beacons”. The website of On Point Insurance Consulting is hosted by BlueHost, which is a Newfold Digital, Inc. (“Newfold”) product.  Newfold may make use of cookies or beacons as outlined in their Privacy Policy. In particular Newfold may collect geolocation data in the form of an IP address and device information, including the type of device and browser used. Information For California Consumers 

If you are a resident of California, you have certain rights to the Personal Data that we have collected about you. Under California law, the exercise of these rights is subject to certain exemptions to safeguard the public interest (e.g., the prevention or detection of crime) and our interests (e.g., maintaining confidentially when legally required ). We will comply with your request as soon as reasonably practicable. Requests to exercise your rights may be granted in whole, in part, or not at all, depending on the scope and nature of the request and applicable law. To prevent unauthorized access to your Personal Data, we take steps to verify an individual’s right to the data – including requiring users to reach out to us directly from a verified email address, pass a challenge response, and/or confirm information associated with the account. Following verification of your identity, we will notify you if we are unable to fulfill your request and outline the reasons we are unable to honor your request at this time.

    • Right of access to your Personal Data: You have the right to ask us for confirmation on whether we are processing your personal data, and access to the Personal data, as permitted by law. This may include what Personal Data we collect, use, or disclose about you.
    • Right to deletion: You have the right to ask us to delete your Personal Data, as permitted by law.
    • Right to Opt-out of “Sale” and Certain Sharing Practices: You have the right to opt-out of certain data sharing practices with third parties who may use your Personal Data solely for their own purposes. Your right to opt-out is limited to information we “sell” to these third parties. “Sell” in this case does not mean providing data in exchange for money-we don’t do that. “Sell” instead means the disclosure of data, including technical device data that does not identify you directly, when a third party might use that data for its own purposes, such as for personalized advertising.

Note to California users between 13 and 16: If you are between the ages of 13 and 16, we do not “sell” your information to these third parties without authorization from you.

  • Right to Non-Discrimination: We will not discriminate against you, in terms of price or services that we offer, if you submit one of the rights requests listed above.

Additional California Rights:

California Civil Code Section 1798.83 permits California residents to request and obtain from us a list of what Personal Data (if any) we disclosed to third parties for that third party’s direct marketing purposes in the preceding calendar year and the names and addresses of those third parties. Requests may be made only once a year and are free of charge.

 

Under Section 1798.83, we currently do not share any Personal Data with third parties for their direct marketing purposes. Additionally, if you are a registered user under the age of 18 and a resident of California, you may request removal of content you have posted to the Services. Requests can be made to info@onpointinsconsulting.com. Please note that making such requests does not ensure complete or comprehensive removal of the content. For example, we may retain the information for our own internal records, and it is also possible that a third party we do not own or control may copy the posting and repost it elsewhere.

 

INFORMATION FOR NEVADA RESIDENTS

Nevada residents can opt out of the sale of their Personal Information. We do not sell Personal Information today, and we do not have plans to sell Personal Information in the future. However, Nevada residents have the legal right to opt out of the sale of their Personal Information, even if their information is not currently being sold. You may opt out by emailing a request to info@onpointinsconsulting.com. In your request, please specify that you want to “Opt-out of Sale of Personal Information in Nevada.” Please allow 60 days for a response. 

WHAT IF I LIVE OUTSIDE THE UNITED STATES? 

If you are visiting us from the European Economic Area, Switzerland, or the United Kingdom, please see the “EUROPEAN USERS” section below.  We are based in the United States, and our website is hosted there.  If you are visiting our website from another country, the laws governing our website’s collection and use of personal information may be different from the laws of your country.  If you decide to visit our website, or share your Personal Information with On Point Insurance Consulting, you are agreeing to be governed by the laws of the United States, and agree to the transfer of your information to the United States.

  • Transfers of personal data outside of the EEA: On Point Insurance Consulting is based in the U.S. and that’s where we process personal data.  When you provide personal data to us, we transfer that personal data to the U.S. We treat the personal data of EEA users in accordance with this Policy.  We take appropriate steps to protect your privacy and implement reasonable security measures to protect your personal data in storage. We also enter into contracts with our data processors that require them to treat personal data in a manner that is consistent with this Policy.
  • Personal data retention: We retain personal data so long as it is necessary for the purpose for which it was collected, and delete personal data after it is no longer needed for these purposes.  This does not affect your right to request that we delete your personal data before the end of its retention period.  We may archive personal data (which means storing it in inactive files) for a certain period of time prior to its final deletion, as part of our ordinary business continuity procedures.

Our website and our social media posts may contain links to third-party websites. Those websites are governed by their own privacy and data use practices and policies.  We do not have control over the privacy practices of the advertisers or other third-parties operating these websites, and we have no control over how these third parties collect or use the information you chose to share with them.  

HOW DOES ON POINT INSURANCE CONSULTING PROTECT MY INFORMATION? 

The security of your personal information is our most important objective.  We use reasonable administrative, physical, and technical safeguards to secure any personal information which you share with us. All information provided by customers using our ordering system is kept strictly confidential and secure to prevent unauthorized use of personal information.

We reserve the right to transfer any information we have about you in the event we sell or transfer all or a portion of our business or assets.
